Only more than two Weeks after the Supreme Court overturned Rowe Wade’s historic victory over anti-abortion Republicans, the Senate Democrats are moving to protect the interstate movement.
The 2022 Freedom of Travel Act, shared only with Hafpost, aims to prevent some attacks by protecting reproductive health services from state to state. Senator Catherine Cortez Mastto (D-Neve) announced the bill Tuesday morning, along with nearly three dozen Democratic sponsor sponsors, including Sen. Patty Murray (D-Wash), Kristen Gilibland (DNI), Richard Bloomingal. (D-Conn.) And Amy Clobuchaar (D-Minn.)

Senate law enshrines the constitutional protections in the 14th Amendment to abortion care for patients traveling through regional lines and to physicians in regions that choose this care. The Freedom of Travel Act is authorized by the United States Attorney General and influential individuals to file civil lawsuits against anyone attempting to restrict access to reproductive health services.
“I know, after I was at home and talking to our health care providers, I know that some laws in other states are having a cold, even in my state,” Cortez Masto told HuffPost. “So we are not only protecting women’s rights and giving us access to vital reproductive health services in states like Nevada, but we are also expecting suppliers and large companies and employers who want to help women. Accept this reproductive care.”
The bill describes reproductive services as “medical, surgical, counseling or referral services related to pregnancy, termination, contraception and other reproductive care.” It also states that the District of Columbia, Puerto Rico and the “United States and Territory” are defined by the proposed law.

Since the fall of Roe, more than a dozen states have banned or severely restricted abortions, and many people could take similar action in the coming weeks – forcing more people to travel along government lines in search of abortion care.
“As I see it, some of the other abortion-related legal issues raised in today’s decision are not particularly difficult as a constitutional issue,” Judge Brett Cavanav wrote in a recent Dobby decision. “For example, does a state prevent a resident of that state from going to another state for an abortion? I believe the answer is no, it is based on the constitutional right to move between states.”
But Kavanaug’s comments on the constitutionality of the Interstate Abortion ban have not stopped some anti-abortion politicians from following that path. Republicans and many anti-abortion groups have already introduced legislation restricting patients from crossing state lines for abortion services.
Christine Noem (R), the governor of South Dakota, who recently banned abortion in almost all of her state, said there was “a debate” on how to handle the future of abortion patients in South Dakota. And state lawmakers have begun trying to restrict interstate travel in places like Missouri and Texas.
Earlier this year, Missouri State Representative Mary Elizabeth Coleman introduced an amendment that would allow private citizens traveling outside of Missouri to be prosecuted for “assisting or harming” anyone. “The bill is an attempt to ensure that life support in Missouri is provided to all Missouri residents and that we can save lives,” Coleman told HuffPost at the time.
Recently, a Texas abortion team followed a Dallas law firm that promised to pay for abortion care. Lawmakers have argued that the employer violated the 1925 abortion ban imposed by Ro. Anti-election Republicans have announced plans to introduce a 2023 legislative session that would make it illegal for any Texas employer to pay for an abortion or travel expenses and allow private citizens to prosecute anyone suspected of paying for an abortion.
Hours after the Supreme Court overturned Row, he said, “Women must remain free to move to another state in peace to receive the care they need, and my administration will properly prevent that eclipse.” If any government or local official – high or low – tries to interfere with a woman who is exercising her basic right to travel, I will do my best to fight that non-American violence.
Restrictions on interstate travel for abortion “are anti-feminist, anti-labor, anti-commercial and in fact they are constitutional,” Cortes Mastto said.
Murray told the Huff Post that Republicans want to use their constitutional rights to imprison women in their own states to get the care they need in our country.
“Restricting women’s right to travel on state lines is not really extremist and American,” Murray said. Our law protects Americans’ constitutional right to travel legally through abortions – and to caregivers. As Republicans go to extremes to seize our constitutional rights, Democrats are struggling to protect them.
